The User is authorised to access the Website to download and view content (Website Content) and interact with our AI Chatbot for personal, non-commercial use.

• Chatbot Interaction: The Website provides an AI-powered chatbot capable of processing text and voice inputs. By using these features, you authorise Pixel Boss to record, process, and archive these interactions for the purpose of delivering and improving the service.
• Prohibited Use: The User is not permitted to use the Website Content or AI Chatbot for any purpose that is unlawful, defamatory, harassing, or intended to "jailbreak" or otherwise circumvent the AI's safety guidelines. Attempts to misuse or reverse-engineer the platform are strictly prohibited.

All Website Content — including but not limited to text, design, code, data, trademarks, and the SWiiFT Studio platform — is protected by copyright and other intellectual property laws and remains the property of Pixel Boss Pty Ltd or its licensors.

• User Inputs: You retain ownership of any text or voice data you provide. However, by using the AI Chatbot, you grant Pixel Boss a non-exclusive, worldwide, royalty-free licence to use, host, and store your inputs (text and voice) to provide the service and improve our AI responses.
• AI Outputs: Any text or audio generated by the AI in response to your input is provided "as is." Pixel Boss makes no claim of ownership over the specific output generated for you, but the underlying technology — including ZPEi™ — remains the property of Pixel Boss or its licensors, including ElevenLabs where applicable.

The Website utilises third-party service providers to deliver certain features. By using voice-enabled features, you acknowledge that your voice data may be transmitted to ElevenLabs for the purpose of voice synthesis and processing. ElevenLabs operates under its own terms of service and privacy policy.

Pixel Boss is not responsible for the data practices of third-party providers, but selects and reviews these providers to ensure reasonable data handling standards.

Pixel Boss does not warrant the accuracy, currency, completeness, or reliability of the Website Content or any AI-generated responses. Users should be aware that AI systems are capable of producing inaccurate or misleading outputs ("hallucinations").

• The User agrees to take all responsibility for assessing the accuracy of any Chatbot output before acting on it. Nothing in any AI-generated response constitutes legal, financial, medical, or professional advice.
• To the extent permitted by applicable Australian law, Pixel Boss excludes all liability for any errors, omissions, losses, or offensive content generated by the AI or contained within the Website.
• Where liability cannot be excluded by law, Pixel Boss limits its liability to the resupply of the relevant service or the cost of having the service supplied again, at Pixel Boss's election.

Pixel Boss collects and handles personal data in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our full Privacy Policy is available on request.

• Active Member Data: Customer data collected through SWiiFT Studio belongs to the venue or brand operating the platform — not to Pixel Boss. Venues are responsible for their own compliance with applicable privacy laws in relation to their customer data.
• Account Deletion: If you wish to delete your account or any archived chat or voice history, please contact us at [email protected]. We will delete associated data promptly, except where retention is required by law or legitimate business necessity.
• Consent: By using the platform, you consent to the collection and processing of data as described in these Terms. You may withdraw consent at any time by contacting us, subject to any obligations that survive termination.

Access to SWiiFT Studio's paid features is subject to a platform subscription of $49 AUD per month plus active member fees as described on the Pricing page. Subscriptions are billed monthly and may be cancelled at any time with effect from the end of the current billing period.

• Free trial periods are offered at Pixel Boss's discretion and may be withdrawn at any time.
• Pixel Boss reserves the right to update pricing with reasonable notice to existing subscribers.
• No refunds are provided for partial billing periods unless required by Australian Consumer Law.

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria and the federal courts of Australia.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law, which provides non-excludable guarantees in relation to services supplied to consumers.

Pixel Boss reserves the right to update or amend these Terms at any time. Continued use of the Website following notification of changes constitutes acceptance of the updated Terms. The date of the most recent update is always displayed at the top of this page.
